1) Promotion Description:NETSCOUT (the “Sponsor”) is offering “Twitter Tales of Interference Contest” (the “Promotion”) and will determine winners and award prizes based on the decisions of a Judging Panel.The Promotion begins 2015 年 8 月 24 日 at 12:00:01 AM Pacific Time (“PT”) and ends 2015 年 9 月 6 日 at 11:59:59 PM PT (“Promotion Period”).Within the Promotion Period there are two (2) Weekly Contest Entry Periods conducted according to the following schedule:

Entries submitted in each Weekly Entry Period will be reviewed by the Sponsor’s judging panel and will be eligible only for the Weekly Entry Period in which they are submitted.The judging process for both Weekly Entry Periods will be completed to no later than 2015 年 9 月 8 日.

2) Eligibility:This is a business-to-business Promotion open to legal residents of the fifty (50) United States, the District of Columbia and Canada who are eighteen (18) years of age or older, have an active Twitter account and have wireless network management and/or maintenance responsibilities.Employees, officers and directors of Sponsor, its advertising, promotional, fulfillment and marketing agencies (collectively the “Promotion Entities”), their immediate families (parent, grandparent, child, sibling & spouse) and persons living in the same households as such individuals (whether related or not), are not eligible to participate in the Promotion.Void in Puerto Rico, all other U.S. territories and possessions and overseas military installations and where prohibited or otherwise restricted by law, rule or regulation.All federal, state and local laws and regulations apply.

3) 如何参与:   The Sponsor is interested in hearing about unusual, challenging and out of the ordinary interference sources that you have detected on your wireless network.Access your Twitter account, follow @FlukeNetENT and use the hashtag #TalesOfRFInterference to post your description of the craziest wireless network interference source you have detected, (your “Contest Submission”).  There is no limit to the number of Contest Submissions you make providing that each are completely factual and reflect entirely different content. 

All Contest Submissions become the sole and exclusive property of Sponsor and receipt of entries will not be acknowledged or returned.By entering, you agree that you hereby license the rights to use the content in your Contest Submission to the Sponsor for advertising and promotion of its products and/or its company in any media now known or hereafter developed in perpetuity in exchange for no compensation of any kind.In the event of a dispute regarding an Entry received from multiple users having the same Twitter account, the authorized subscriber of the Twitter account at the time of submission will be deemed to be the entrant and must comply with these Official Rules.

4) Judging and Winner Determination: Contest Submissions will be reviewed by the Sponsor’s judging panel  (“Judging Panel”) on the basis of the most unusual, unexpected and/or out of the ordinary cause of wireless network interference. The Judging Panel will determine one (1) potential winner (“Potential Winner”) in each of the two (2) Weekly Entry Periods.If two or more different people submit identical/duplicate Contest Submissions, the first Entry submitted (based on chronological time/date of entry) will be considered for eligibility and any subsequently received identical/duplicate Contest Submission will be void. The decisions of the Sponsor and Judging Panel in all matters relating to this Promotion are final and binding.At Sponsor’s sole discretion, if an inadequate number of Contest Submissions are received and/or are inadequate in quality, Sponsor reserves the right NOT to select any Contest Submissions as winners or to select fewer than two (2) Potential Winners.

5) Data Collection –By entering the Promotion, you agree to all of the terms and conditions of Sponsor’s Privacy Policy, which is available at /about/privacy.

6)  Prizes and Approximate Retail Values – Each of the two (2) weekly winners will each receive a Fire HD 6 by Amazon (6” HD Display, Wi-Fi, 8 GB),  Approximate Retail Value (“ARV”) $99 USD  each.There are two (2) prizes available with a total retail value of $188 USD.In the event a Canadian entrant is determined to be a winner, Sponsor reserves the option to award the Fire HD 6 by Amazon as the cash equivalent in USD.

All federal, state and other taxes on prizes are solely the responsibility of the winners.There are no prize substitutions or options available, except at Sponsor’s sole discretion.However, Promotion Entities reserve the right, exercisable at any time in their sole discretion, to substitute a prize of equal or greater value.Any costs associated with prize acceptance and use not specified herein as being provided, is the Official Winner’s sole responsibility.

7) Winner Confirmation:Potential Winners will be contacted within two (2) business days of the Judging Period via  message from the Sponsor on his/her Twitter account (“Prize Notification”).The potential winners will have five (5) days from Sponsor’s first Prize Notification to respond with confirmation of prize acceptance and provide a complete name and shipping address for the purposes of prize fulfillment.Any potential winner has the option to accept the prize personally or to assign it to his/her employer.Failure to respond within the state time frame will result in disqualification and at Sponsor’s sole discretion an alternate winner will be named.Any unclaimed prizes will not be awarded.

8) 一般规则: 所有参加者都同意完全遵守这些正式规则中的各条款。任何人若试图欺骗或以任何方式干预本次促销活动和不遵守这些正式规则,则取消其获奖资格,并可能依法对其起诉。If, during  the Promotion Period, for reasons beyond the Sponsor’s control (including, but not limited to, tampering or computer virus infection), the Promotion is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel or modify the Promotion, without liability and to the extent feasible, and will determine  winners and award prizes from among Contest Submissions received prior to cancellation or modification in accordance with the same judging criteria set forth above.Sponsor is not responsible for Internet, computer hardware and software, phone, and other technical errors, malfunctions, and delays.Entries, which are incomplete, inaccurate, irregular, or otherwise not in compliance with these Official Rules, are void.

9) Right to Use Your Work:By submitting an Entry, you: (a) represent and warrant that your Contest Submission is truthful, factual and does  not incorporate or include anything that is owned by any third party or would require the consent of any third party and your Contest Submission does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party; (b) agree to abide with all terms and conditions as set forth in these Official Rules; (c) automatically grant to the Sponsor an exclusive, world-wide, royalty free, irrevocable license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute and display your Contest  Submission; (d) agree that if selected as a winner of any prize, your Contest Submission shall legally be considered a "work made for hire," with all rights therein, including, without limitation, the exclusive copyright, transferred to and being the property of the Sponsor; and (e) agree that upon selection as a winner of any prize, in the event your Entry is considered not to be a "work made for hire," you irrevocably assign to the Sponsor all right, title, and interest in and to your Contest Submission (including, without limitation, the copyright) in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right (among all other ownership rights) to make any and all uses thereof, including, without limitation, for purposes of advertising or trade.The rights granted under this paragraph shall extend to the Sponsor and its affiliated companies with respect to all entries and all other submitted materials related to the Promotion, including those submitted by non-winners and winners.

By submitting an Entry, you grant to the Sponsor and its affiliated companies the right to use your name, likeness, picture, address (city and state), voice, biographical information, and any written or oral statements, for advertising and promotional purposes in promoting or publicizing the Sponsor, its products or services, without notice or compensation in perpetuity in any media now known or hereafter developed except where prohibited by law.您无权批准、无权要求赔偿,也不会因使用、玷污、更改或以各种形式使用您的姓名、照片、肖像、地址(市和州)、电子邮件地址、履历信息或参加表格而得到赔偿(包含但不限于对侵犯隐私、破坏名誉或形象权的索赔)。The rights granted under this paragraph shall extend to the Sponsor, its affiliated companies with respect to all entrants in the Promotion, including non-winners and winners.The Sponsor however, does not have any obligation to use the winning or non-winning Entries for any purpose.

10) Release of Liability and Issues of Law: By participating in this Promotion, all entrants release NETSCOUT, its parent, subsidiary and its affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this promotion from any and all liability with respect to and in any way arising from participating in this promotion, acceptance or use of prizes.参加者还同意 NETSCOUT 及其总公司、子公司、附属公司、合作伙伴、高管、董事、代理人、员工及所有与此次促销活动的部署和执行相关的所有实体均无需对给参加者或第三方计算机造成的或者促销活动、参加表格和/或奖品造成的相关伤害或损害负责。主办者不对由于(直接或间接)参加者参加促销活动或下载与促销活动相关的信息对用户计算机系统造成的损害(包括但不限于任何严重故障或数据丢失、延迟或破坏数据或其它故障)负责。若管理促销活动的各方面的任何网站的任何部分发生技术故障,主办者保留修改或取消促销活动的权利。参加者提供的促销活动注册资料在美国进行处理,并遵从美国隐私法。
